General Conditions of Sale of Cosmedia 78

These Terms and Conditions of Sale (hereinafter: « GTC ») govern relations between Cosmedia 78, company specializing in digital communication, content creation, design & branding, and event management, and any customer purchasing a service via the site Commedia 78 | The world of communication.

By placing an order, the customer acknowledges that he has read and accepted these Terms and Conditions without reservation.

2. Subject matter

These Terms and Conditions define the terms and conditions for the sale and performance of the following services:

• Communication strategy
• Content creation (writing, visuals, videos, etc.)
• Digital marketing (online advertising, SEO, social media management)
• Design & branding (visual identity, communication media)
• Event services (DJ, photography, video, public relations)

3. Order and acceptance

Any delivery order can be made via:

• The website Commedia 78 | The world of communication
• A personalized quote sent by e-mail
• Direct exchange (telephone, video conferencing, etc.)

The order is validated after receipt of the payment (total or down payment according to the terms defined). The acceptance of the estimate is a contractual undertaking between the parties.

4. Rates and methods of payment

• Prices of services are expressed in euros, excluding taxes and all taxes included.
• Payments can be made by bank transfer and credit card.
• A down payment of Minimum 30 % may be required for any order.
• The balance must be paid before the final delivery of the service, unless otherwise agreed.
• Any delay in payment will result in penalties for 10% of the amount due per month of delay, and any recovery costs.

5. Right of withdrawal

In accordance with article L221-28 of the Consumer Code, digital and tailor-made services are not subject to the right of withdrawal After validation of the command and start running.

Any request for cancellation must be in writing and may incur costs corresponding to the work already done.

6. Delivery and delivery

• Time limits : Delivery times are agreed between the parties and vary according to the delivery. Any delay due to the client (delay of validation, transmission of content) will not be liable to Cosmedia 78.
• Revisions : Depending on the performance, a limited number of returns and changes are included. Any additional request may be subject to additional billing.

7. Responsibilities and obligations

• Cosmedia 78 is committed to provide a quality service consistent with the expectations defined with the customer.
• Customer commits provide all the information necessary for the smooth running of the service.
• Limitation of liability : Cosmedia 78 cannot be held responsible for the consequences of improper use of deliverables or of items provided by the customer.

8. Intellectual property

• Digital creations (design, texts, videos, etc.) Cosmedia 78 retains the intellectual property of creations until full payment of the service.
• Use of deliverables : Unless otherwise stated, the customer shall obtain a right to exploit the deliverables for agreed use.
• Right of dissemination : Cosmedia 78 reserves the right to display certain achievements in its portfolio, unless the client objects in writing.

9. Confidentiality and data protection

The information transmitted by the customer is strictly confidential and used only for the performance of the services.

10. Major Force

Cosmedia 78 cannot be held responsible for delays or non-execution in the event of force majeure (natural disaster, major breakdown, legal restrictions, etc.).

11. Litigation and applicable law

In the event of a dispute, a friendly solution will be sought as a matter of priority. Otherwise, any dispute will be referred to the competent courts of the headquarters of Cosmedia 78.
